PROPOSED GENERAL PLAN AMENDMENT

COUNTY OF SAN DIEGO

NOTICE IS HEREBY GIVEN that the County of San Diego Board of Supervisors will hold a public hearing on a County-initiated General Plan Amendment.

HEARING INFORMATION:

PROJECT:  2017 General Plan Clean-Up; GPA 16-001; REZ 16-001

PROJECT DESCRIPTION: The 2017 General Plan Clean-Up is a County initiated General Plan Amendment that includes proposed changes to the Land Use Map/Zoning, Mobility Element Network Appendix, and Implementation Plan.  The General Plan Clean-Up takes places every two years and is intended to provide a regular mechanism for making necessary corrections to errors discovered during implementation of the General Plan and to reflect changed circumstances. General Plan Clean-Up items have generally been limited to ownership changes, mapping errors, errors and omissions, minor community plan changes, and internal clarification and inconsistencies.

SUMMARY OF FUNDING:  There is no fiscal impact associated with these recommendations. There will be no change in net General fund cost and no additional staff years.

ENVIRONMENTAL REVIEW: An EIR Addendum to the previously certified Environmental Impact Report for the County of San Diego General Plan Update, certified August 3, 2011 (ER 02-ZA-001; SCH 2002111067), has been prepared pursuant to the California Environmental Quality Act.

COUNTY OF SAN DIEGO

AIR POLLUTION CONTROL DISTRICT

NOTICE OF PUBLIC HEARING

NOTICE, pursuant to Section 40725 of the California Health and Safety Code and Section 51.102 of the Code of Federal Regulations, is hereby given of a public hearing on November 15, 2017, at 9:00 a.m., before the Air Pollution Control Board (Board) of the County of San Diego, in Room 310, County Administration Center, 1600 Pacific Highway, San Diego, California, for the purpose of receiving public comments on and considering the adoption of proposed new Rule 1206 (Asbestos Removal, Renovation, and Demolition), related amendments to Rule 40 (Permit and Other Fees), and the repeal of existing Rules 361.140-361.156 (National Emissions Standards for Asbestos) of the San Diego County Air Pollution Control District (District).

Asbestos is a known human carcinogen and there is no known threshold exposure level below which adverse health effects are not anticipated.  Asbestos is federally regulated through the National Emissions Standards for Hazardous Air Pollutants (NESHAP).  The U.S. Environmental Protection Agency (EPA) has delegated NESHAP implementation authority to the District.  The District enforces this federal regulation locally through existing Rules 361.140-361.156, adopted in 1995.   However, since then, the EPA has made numerous amendments and determinations to improve and clarify the federal regulation.  Accordingly, proposed new Rule 1206 reflects these updates and will enhance awareness, facilitate compliance and increase public health protection.  

Proposed new Rule 1206 more clearly defines terms, better explains inspection and reporting requirements, clarifies when a renovation or demolition is subject to the requirements, and specifies work practice requirements to limit asbestos exposure.  Additionally, to better protect public health, the applicability threshold would decrease from 160 square feet to 100 square feet of regulated asbestos-containing material to be removed.  A related minor amendment to existing Rule 40 for asbestos notification fees is also proposed to incorporate this threshold change.                                                                                                      

The Board may consider modifications to the proposal, which may be deemed appropriate.  Written comments are also invited.  Comments should be addressed to:

COUNTY OF SAN DIEGO CONSORTIUM 2017-18 ANNUAL FUNDING PLAN

AMENDMENT TO THE FISCAL YEAR 2017-18 COUNTY OF SAN DIEGO ANNUAL FUNDING PLAN  TO REALLOCATE HOME INVESTMENT PARTNERSHIP GRANT FUNDS AND ESTABLISH A TENANT BASED RENTAL ASSISTANCE PROGRAM FOR HOMELESS PERSONS IN THE UNINCORPORATED AREA

Notice is hereby given that the Board of Supervisors will hold a public hearing on November 14, 2017 at 9:00 a.m. in Room 310 at the County Administration Center, 1600 Pacific Highway, San Diego, CA, to receive public comment on the reallocation of HOME Investment Partnership funds and the amendment to the Fiscal Year 2017-18 County of San Diego Annual Funding Plan to include a Homeless Tenant Based Rental Assistance Program.

The Annual Plan describes proposed activities to be funded from FY 2017-18 and previous year entitlements, which must meet the goals established in the Consolidated Plan.    The Board will consider an amendment to the FY 2017-18 Annual Funding Plan for the reallocation of up to $500,000 in HOME Investment Partnership program funds from completed or canceled projects to a new Fiscal Year 2017-18 Homeless Tenant Based Rental Assistance Program (TBRA) .

PROJECT DESCRIPTION: The applicant proposes a Zone Reclassification (REZ), Tentative Map (TM), and a Major Use Permit (MUP) for a mixed-use planned development consisting of 332 single-family residential units, a 4.2-acre commercial center, a 2.6-acre public park, 1.9 acres of private parks, and a 1.6-acre private recreational facility. The REZ changes the existing Holding Zone Use Regulation (S90) to the General Commercial Use Regulation (C36) and the Variable Residential Use Regulation (RV). The TM subdivides the 73.9-acre site into 332 residential, 13 open space, five park, and two commercial lots. The MUP proposes a planned development pursuant to Section 6600 of the County Zoning Ordinance and demonstrates conformance with the Valley Center Design Guidelines. Access will include new public and private roads and private driveways connecting to Valley Center Road, Mirar De Valle Road, and Old Road, which are public roads. The project site is zoned Rural Residential (RR), RV, and S90 and is subject to the Village Core Mixed Use (VCMU), Village Residential (VR-7.3), and Rural Lands (RL-20) General Plan Land Use Designations.

LOCATION: The project site is located at 27654 Valley Center Road in the Valley Center Community Plan Area, within unincorporated San Diego County (APNs: 186-240-11 and 186-240-12).

ENVIRONMENTAL STATUS: The project has been reviewed for compliance with the California Environmental Quality Act (CEQA) and the project qualifies for an exemption from additional environmental review pursuant to CEQA Guidelines §15183. CEQA Guidelines §15183 provides an exemption from additional environmental review for projects that are consistent with the development density established by the General Plan for which an Environmental Impact Report (EIR) was certified. For the proposed project, the planning level document is the General Plan Updated EIR, certified by the Board of Supervisors on August 3, 2011.

PLANNING COMMISSION RECOMMENDATION: On August 4, 2017, by a vote of 7-0-0-0-0 (Ayes-7; Noes-0), the Planning Commission recommended approval of the project.

RESOLUTION NO. 17-006

RESOLUTION OF INTENTION BY THE COUNTY OF SAN DIEGO TO CONSIDER PROPOSALS FOR THE GROUND LEASE AND DEVELOPMENT OF COUNTY PARCELS 2014-0210-B AND 2014-0210-C 

WHEREAS, the County of San Diego (“County”) owns property located in the City of San Diego, County of San Diego, State of California as follows:

Two parcels of land approximately 25,699 square feet in size bounded by Cedar Street, Kettner Boulevard, Beech Street, and a railroad right-of-way in the City of San Diego (“Parcels”).  The Parcels comprise Assessor Parcel Numbers 533-322-04, 05, 06, 07, 09 and 10, and are further identified as County Parcel 2014-0210-B consisting of approximately 8,624 square feet and County Parcel Number 2014-0210-C consisting of approximately 17,075 square feet.

WHEREAS, the County has declared the Parcels no longer necessary for the County’s use; and

WHEREAS, the County desires to consider proposals for the ground lease and development of both Parcels for residential and/or commercial use, which will maximize the value of the Parcels; and

WHEREAS, pursuant to applicable laws of the State of California, including Article 7.5 of Chapter 5 of Part 2 of Division 2 of Title 3 of Government Code, consisting of Sections 25515 through 25515.5 the County is authorized to market the Parcels using a Request for Proposals process; and

WHEREAS, the County desires to use a two-step process by first soliciting responses to a Request for Statement of Qualifications from parties interested in ground leasing and developing both of the Parcels, and then by allowing selected proposers determined to have the appropriate qualifications respond to a Request for Proposals, with responsive proposals to be received at a public meeting of the Board of Supervisors as described below; and

WHEREAS, in order to comply with the law, before authorizing the development, contract agreement, lease or sale of the Parcels, the County must adopt a resolution declaring its intention to consider proposals, describe the proposed site, specify that the site is intended to be used for commercial and/or residential development, and fix a time not less than 60 days thereafter for receipt of proposals at a public meeting of the Board of Supervisors; and

WHEREAS, notice of the adoption of this Resolution and the time and place of the public meeting must be published at least once a week for three weeks;

NOW, THEREFORE, be it resolved as follows:

Section 1.  This Board of Supervisors declares its intention to consider proposals for ground lease and development of both of the Parcels for residential and/or commercial purposes.

Section 2.  The Request for Statement of Qualification documents will be available from and received by the County’s Department of General Services, Real Estate Services Division, 5560 Overland Avenue, Suite 410, San Diego, California 92123.

Section 3.  The Request for Proposals documents will be available from the County’s Department of General Services, Real Estate Services Division, 5560 Overland Avenue, Suite 410, San Diego, California 92123.

Section 4.  That all responses to the Request for Statement of Qualifications and Request for Proposals for the Parcels shall be submitted in conformance with requirements determined by the County’s Department of General Services, Real Estate Services Division.

Section 5.  That all responses to the Request for Proposals will be received as follows:

Proposals will be received until 9:00 a.m. on October 10, 2017, at which time they will be received by the Board of Supervisors at its regular place of meeting, the chambers in Room 310 at the County Administration Center at 1600 Pacific Highway, San Diego, California 92101.

The County will only receive proposals from proposers determined to be qualified by the Director, Department of General Services, through the Request for Statement of Qualifications process.

Section 6.  That notice of the adoption of this resolution shall be published in a newspaper of general circulation within San Diego County once a week for three weeks prior to the public meeting described above.

Section 7.  That the Board of Supervisors reserves the right to reject any and all proposals.
