MAJOR VIOLATIONS

Under state law, major violations associated with the Centers for Disease Control and Prevention risk factors require immediate corrective action, a suitable alternative, or the closure of the impacted areas of the food facility until compliance is achieved.

COMPLIANCE WITH GULF OYSTER REGULATIONS

Examples of major violations include raw Gulf Oysters offered for sale without proper warning signs posted that are clearly visible to the consumer at time of ordering, or Gulf Oysters that are offered for sale without proof of process certification.

REQUIREMENTS

  • During the months of November through March, warning signs are required to be posted for the consumption of raw Gulf oysters (Title 17 CA Code of Regulations §13675)
  • During the months of April through October, only Gulf Oysters that have been subjected to an approved oyster treatment process and that are clearly tagged or labeled "PROCESSED TO REDUCE VIBRIO VULNIFICUS TO NON-DETECTABLE LEVELS", shall be served or sold (Title 17 CA Code of Regulations §13675)
  • The food facility must keep a current copy of process certification issued by the California Food & Drug branch on file (Title 17 CA Code of Regulations §13675)
