Conflict of Interest Code

Under the Political Reform Act ("the Act"), all public agencies must adopt a Conflict of Interest Code. The code lists positions required to file a Statement of Economic Interests (Form 700) and assigns disclosure categories. These categories define the types of financial interests each position must report. The Form 700 is a public document. It alerts public officials and the public to financial interests that may create a conflict of interest. 

Three Parts of the Code 

1. Terms of the Code 

The terms make up the main body of the code. They tell how to report financial interests and other key rules. The FPPC recommends adopting FPPC Regulation 18730 by reference. It covers all the complex rules needed. The FPPC updates it when laws change. Your code stays in line with the Act. 

2. Designated Positions 

The code must list all positions that make or take part in decisions. These include positions that vote, work out contracts, or suggest purchases without major review. It also includes positions listed in Government Code Section 87200, such as Planning Commissioners, Members of the Board of Supervisors, Chief Administrative Officer, District Attorney, County Counsel, Treasurer/Tax Collector, and officers who handle public investments. 

3. Disclosure Categories 

The code requires disclosure of financial interests that may affect decisions. This includes investments, real property interests, sources of income, and business positions held by those positions.
